1. Agreement
These Terms of Service ("Terms") govern your use of mrfreshcarpetcare.com (the "Site") and any services performed by Mr. Fresh Carpet Care ("Mr. Fresh," "we," "us," or "our"). By visiting the Site, submitting a quote request, or booking a service, you agree to these Terms. If you do not agree, do not use the Site or our services.
2. Services
We provide carpet cleaning, upholstery cleaning, tile and grout cleaning, water damage restoration, mold remediation, and related residential and commercial services in the Greater Bay Area, including Solano County and surrounding counties. The scope of any specific job is set by the written estimate or work order we provide before work begins.
3. Estimates and pricing
- Estimates are based on the information you provide and a visual inspection.
- Final invoices may differ if conditions on site differ from what was described, if additional rooms or surfaces are added, or if hidden damage is found. We will tell you before doing additional work.
- Emergency response and after-hours work may carry premium rates, disclosed in advance.
- Prices are in US dollars. Payment is due on completion unless arranged otherwise in writing.
4. Insurance work
When work is being billed to an insurance carrier, you remain the customer of record. You authorize us to communicate with the carrier and submit documentation on your behalf. Any deductible, depreciation, or non-covered scope remains your responsibility. We do not guarantee carrier acceptance of any specific line item.
5. Access and customer responsibilities
- You agree to provide reasonable access to the property and a working source of water and electricity during service.
- You agree to remove or move fragile or high-value items before our arrival, unless we agree in writing to handle them.
- You agree to disclose any known hazards (mold, sewage, asbestos, pets, allergens) before work begins.
6. Warranty and limitations
We perform our services using IICRC-aligned methods and reasonable professional care. Cleaning results depend on factors outside our control, including fiber type, prior treatments, soiling level, and pre-existing damage. We do not warrant the removal of every spot or stain, the restoration of damaged carpet to new condition, or specific drying timelines on water damage jobs.
If you are not satisfied with a cleaning service, notify us within 48 hours and we will return to re-clean the affected area at no additional charge, where applicable.
7. Limitation of liability
To the maximum extent permitted by California law, our total liability for any claim arising from a service is limited to the amount you paid for that service. We are not liable for indirect, consequential, or incidental damages, including lost income, lost data, or loss of use, except where the law does not allow such limits.
8. Cancellation
You may cancel a non-emergency scheduled service up to 24 hours before the start window without charge. Cancellations under 24 hours may be charged a reasonable trip fee. Emergency water damage dispatches are treated as confirmed once a crew is en route; cancellations after dispatch may be charged a mobilization fee.
9. Website use
The Site is provided for informational purposes. Content on the Site, including text, images, and structured data, is the property of Mr. Fresh Carpet Care and may not be copied or republished without written permission. You agree not to use the Site to disrupt our systems, scrape data at scale without permission, or impersonate any person.
10. Dispute resolution and governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved first by good-faith negotiation. If that fails, the dispute will be resolved in the state or federal courts located in Solano County, California, unless both parties agree in writing to arbitration.
11. Changes to these Terms
We may update these Terms periodically. The "Last updated" date at the top will reflect any changes. Material changes will be flagged near the top for at least 30 days. Continued use of the Site or our services after a change constitutes acceptance.
